各(ge)區住房城鄉建(jian)設(she)委,東城、西城、石景山區住房城市建(jian)設(she)委,經濟技術開(kai)發區行(xing)政審批局(ju)、開(kai)發建(jian)設(she)局(ju),各(ge)有關單位:


  為(wei)深入貫徹落(luo)實(shi)《北京市(shi)優(you)(you)(you)化(hua)(hua)(hua)營(ying)商(shang)(shang)環(huan)境(jing)條例》和《北京市(shi)全面優(you)(you)(you)化(hua)(hua)(hua)營(ying)商(shang)(shang)環(huan)境(jing) 助力(li)企業高(gao)質量發展實(shi)施(shi)方案》,持續(xu)推進我市(shi)優(you)(you)(you)化(hua)(hua)(hua)營(ying)商(shang)(shang)環(huan)境(jing)改革工(gong)作,加(jia)快建設(she)項(xiang)目落(luo)地開工(gong),依據《關(guan)于進一步(bu)優(you)(you)(you)化(hua)(hua)(hua)建筑工(gong)程施(shi)工(gong)許可證審批工(gong)作的通(tong)知》(京建發〔2018〕559號)和《關(guan)于完善施(shi)工(gong)準備(bei)函有(you)關(guan)事項(xiang)的通(tong)知》(京建發〔2019〕349號)等相關(guan)規(gui)定,現(xian)就進一步(bu)規(gui)范和完善施(shi)工(gong)準備(bei)函管(guan)理有(you)關(guan)事項(xiang)通(tong)知如下:


  一、對本市行(xing)政(zheng)區(qu)(qu)域內單(dan)體建(jian)筑面積1萬(wan)(wan)平方(fang)(fang)米(mi)(mi)(含(han))以(yi)上(shang)(shang),或者(zhe)群體建(jian)筑面積5萬(wan)(wan)平方(fang)(fang)米(mi)(mi)(含(han))以(yi)上(shang)(shang),且(qie)土方(fang)(fang)開挖(wa)作業(ye)量(liang)城六(liu)區(qu)(qu)及副中(zhong)心155平方(fang)(fang)公(gong)里范圍內3萬(wan)(wan)立(li)方(fang)(fang)米(mi)(mi)(含(han))以(yi)上(shang)(shang)、其他區(qu)(qu)域5萬(wan)(wan)立(li)方(fang)(fang)米(mi)(mi)(含(han))以(yi)上(shang)(shang)的房屋建(jian)筑工(gong)程(cheng)項目(mu),以(yi)及基坑(keng)深度(du)在5米(mi)(mi)(含(han))以(yi)上(shang)(shang)且(qie)開挖(wa)土方(fang)(fang)作業(ye)量(liang)達10萬(wan)(wan)立(li)方(fang)(fang)米(mi)(mi)(含(han))以(yi)上(shang)(shang)的市政(zheng)建(jian)筑工(gong)程(cheng)項目(mu),可依(yi)建(jian)設(she)單(dan)位申請,對土方(fang)(fang)、護(hu)坡、降(jiang)水工(gong)程(cheng)(以(yi)下簡(jian)稱“土護(hu)降(jiang)”工(gong)程(cheng))單(dan)獨辦(ban)理(li)招投標和核發施(shi)工(gong)準備(bei)函。


  二、施(shi)(shi)(shi)(shi)工(gong)準備(bei)函辦(ban)(ban)理(li)要件和流程,繼(ji)續(xu)依(yi)照《關于進一步優化建(jian)(jian)筑工(gong)程施(shi)(shi)(shi)(shi)工(gong)許可證審批(pi)工(gong)作的通(tong)知》(京(jing)建(jian)(jian)發〔2018〕559號(hao)(hao))和《關于完(wan)善施(shi)(shi)(shi)(shi)工(gong)準備(bei)函有關事項(xiang)的通(tong)知》(京(jing)建(jian)(jian)發〔2019〕349號(hao)(hao))等文件規定執行。項(xiang)目建(jian)(jian)設(she)(she)單位在具(ju)備(bei)以下(xia)條(tiao)件后,可按(an)照市、區施(shi)(shi)(shi)(shi)工(gong)許可辦(ban)(ban)理(li)權(quan)限(xian)范圍,向市或區住房城(cheng)鄉(xiang)(市)建(jian)(jian)設(she)(she)委(wei)提出辦(ban)(ban)理(li)施(shi)(shi)(shi)(shi)工(gong)準備(bei)函的書面申請(qing)。


  1.設計(ji)方(fang)案(an)已基本穩定,并且已取得由規(gui)劃自然資源部門出具的相關規(gui)劃設計(ji)方(fang)案(an)審查(cha)確認文件。文件應(ying)包(bao)含(han)項目(mu)四至(zhi)范圍和用地性質、建(jian)筑規(gui)模、建(jian)筑高度、建(jian)筑使用性質及地下工程初(chu)步建(jian)設指(zhi)標或方(fang)案(an)等。


  2.施工場地已基本(ben)具備(bei)施工條件,場地平整,地上物已全部拆除,無樹(shu)木(mu)或(huo)各類(lei)線桿。涉(she)及古(gu)樹(shu)名木(mu)的,已取得園林綠化部門批準的工程建設避讓(rang)保護古(gu)樹(shu)名木(mu)措施手續。


  3.已(yi)基本完(wan)成地(di)下管線勘探和物(wu)探、考(kao)古調查(cha)及地(di)質勘查(cha)等(deng)工(gong)作,并取得相應(ying)報告(gao)。


  4.已基本完成“土護降”工程(cheng)施工圖(tu)紙(zhi)設計和土方開挖、地下水控制(zhi)設計施工方案。


  5.前(qian)期立項、規劃(hua)等手(shou)續在辦理(li)過程中進度滿足主體工(gong)程施工(gong)前(qian)辦理(li)施工(gong)許可證的要求(qiu)。涉(she)及農用(yong)(yong)地轉用(yong)(yong)和土地征收(shou)的,須取(qu)得(de)建(jian)設用(yong)(yong)地批準手(shou)續。


  三、市住房(fang)城鄉(xiang)建設委(wei)依申(shen)請(qing)組織質量(liang)、安(an)(an)全、監督(du)、執法、招標等(deng)(deng)(deng)部(bu)門,及區住建委(wei)相關部(bu)門開展(zhan)聯審(shen)(shen),對項目設計和施工(gong)方(fang)案(an)、質量(liang)和安(an)(an)全管理措施、招投標計劃安(an)(an)排、前期手續(xu)辦理進(jin)度等(deng)(deng)(deng)情(qing)況(kuang)進(jin)行綜合研判。聯審(shen)(shen)工(gong)作可視項目情(qing)況(kuang)邀請(qing)發展(zhan)改革、規劃自然(ran)資(zi)源(yuan)等(deng)(deng)(deng)部(bu)門和第三方(fang)專業機構參與會商(shang)。


  四、通過市、區聯審(shen)(shen)的(de)項目(mu)(mu)(mu),其(qi)中對社會(hui)投資項目(mu)(mu)(mu),建設單位應(ying)在(zai)三個月內(nei)(nei)申辦(ban)施(shi)工(gong)(gong)(gong)準(zhun)(zhun)備(bei)(bei)函;對政府(fu)投資項目(mu)(mu)(mu),依法應(ying)當(dang)招標的(de)應(ying)在(zai)四個月內(nei)(nei)申辦(ban)施(shi)工(gong)(gong)(gong)準(zhun)(zhun)備(bei)(bei)函。同時將項目(mu)(mu)(mu)“土護降”工(gong)(gong)(gong)程(cheng)納入(ru)質量、安全監督管(guan)理。逾(yu)期未(wei)申辦(ban)或經審(shen)(shen)查不合(he)格的(de),不再予以辦(ban)理。已取得(de)施(shi)工(gong)(gong)(gong)準(zhun)(zhun)備(bei)(bei)函的(de)項目(mu)(mu)(mu),須在(zai)施(shi)工(gong)(gong)(gong)準(zhun)(zhun)備(bei)(bei)函取得(de)之(zhi)日(ri)起(qi)三個月內(nei)(nei)實質開工(gong)(gong)(gong);逾(yu)期未(wei)開工(gong)(gong)(gong)的(de),施(shi)工(gong)(gong)(gong)準(zhun)(zhun)備(bei)(bei)函自(zi)行廢止。


  五、市、區住房城鄉(市)建(jian)設委應加(jia)強對發放施(shi)(shi)工(gong)(gong)準(zhun)(zhun)備(bei)(bei)函(han)項目(mu)的事(shi)中(zhong)事(shi)后監管。施(shi)(shi)工(gong)(gong)許可審批管理部(bu)門應參照“雙隨機、一公開(kai)”檢(jian)查(cha)模式,對已(yi)取得施(shi)(shi)工(gong)(gong)準(zhun)(zhun)備(bei)(bei)函(han)的項目(mu)開(kai)展(zhan)檢(jian)查(cha),建(jian)立(li)監管臺(tai)賬。質量、安全監督機構(gou)應按(an)計(ji)劃(hua)開(kai)展(zhan)監督檢(jian)查(cha)工(gong)(gong)作。對檢(jian)查(cha)中(zhong)發現存在(zai)違法違規行(xing)為或不(bu)履行(xing)承諾、弄虛作假等(deng)違背誠信的,發證(zheng)機關收回施(shi)(shi)工(gong)(gong)準(zhun)(zhun)備(bei)(bei)函(han),一年內不(bu)再受(shou)理該(gai)建(jian)設單位其他項目(mu)施(shi)(shi)工(gong)(gong)準(zhun)(zhun)備(bei)(bei)函(han)辦理申請。


  六、建(jian)設(she)(she)單(dan)位應(ying)(ying)嚴格落實(shi)主體(ti)責(ze)任,遵守國(guo)家和(he)北京市有關建(jian)設(she)(she)工(gong)(gong)(gong)程(cheng)(cheng)的法律(lv)法規和(he)標準規范,加(jia)強“土護降”工(gong)(gong)(gong)程(cheng)(cheng)施(shi)(shi)工(gong)(gong)(gong)過程(cheng)(cheng)中的質量、安全管理(li);要結合(he)項目具體(ti)情(qing)況和(he)特(te)點,提(ti)前謀(mou)劃、務實(shi)設(she)(she)計、科(ke)學論證,做細做實(shi)前期工(gong)(gong)(gong)作,確保施(shi)(shi)工(gong)(gong)(gong)準備階(jie)段(duan)與主體(ti)施(shi)(shi)工(gong)(gong)(gong)階(jie)段(duan)在建(jian)設(she)(she)時序和(he)前期手續上有效(xiao)銜接,最遲應(ying)(ying)在主體(ti)工(gong)(gong)(gong)程(cheng)(cheng)施(shi)(shi)工(gong)(gong)(gong)前取得建(jian)筑工(gong)(gong)(gong)程(cheng)(cheng)施(shi)(shi)工(gong)(gong)(gong)許可證,未取得施(shi)(shi)工(gong)(gong)(gong)許可證的不(bu)得繼續開展后(hou)續主體(ti)工(gong)(gong)(gong)程(cheng)(cheng)施(shi)(shi)工(gong)(gong)(gong);應(ying)(ying)在項目“土護降”工(gong)(gong)(gong)程(cheng)(cheng)完(wan)工(gong)(gong)(gong)后(hou)10個工(gong)(gong)(gong)作日內告知施(shi)(shi)工(gong)(gong)(gong)許可審(shen)批(pi)部門(men)。


  七、市、區住房城鄉(xiang)(市)建設(she)委施工(gong)許(xu)可審批管(guan)(guan)理(li)部門(men)應加強施工(gong)準備(bei)函檔(dang)案管(guan)(guan)理(li),參照建筑工(gong)程施工(gong)許(xu)可證(zheng)檔(dang)案管(guan)(guan)理(li)模式做(zuo)好相關檔(dang)案文件的收集、整理(li)和留存備(bei)查工(gong)作。


  八、為進一步提高審(shen)批效(xiao)率,精(jing)簡審(shen)批材料,便利建設單位,在(zai)辦理建筑工(gong)(gong)程(cheng)施工(gong)(gong)許可證時,住房城(cheng)鄉建設主管部門不再(zai)對(dui)“建筑工(gong)(gong)程(cheng)用地批準手續(xu)”進行重復審(shen)查。


  九、本(ben)通知(zhi)自印發之日起施行。此前《北京(jing)(jing)市(shi)住房(fang)和(he)城鄉建(jian)(jian)設(she)(she)委(wei)員(yuan)會 北京(jing)(jing)市(shi)規劃(hua)(hua)和(he)自然資(zi)源(yuan)(yuan)委(wei)員(yuan)會關于(yu)進(jin)一(yi)步優化(hua)建(jian)(jian)筑工(gong)(gong)程施工(gong)(gong)許可證審批(pi)工(gong)(gong)作(zuo)的(de)通知(zhi)》(京(jing)(jing)建(jian)(jian)發〔2018〕559號)、《北京(jing)(jing)市(shi)住房(fang)和(he)城鄉建(jian)(jian)設(she)(she)委(wei)員(yuan)會 北京(jing)(jing)市(shi)規劃(hua)(hua)和(he)自然資(zi)源(yuan)(yuan)委(wei)員(yuan)會關于(yu)完善施工(gong)(gong)準備函有(you)關事(shi)項的(de)通知(zhi)》(京(jing)(jing)建(jian)(jian)發〔2019〕349號)規定與(yu)本(ben)通知(zhi)不一(yi)致的(de),以本(ben)通知(zhi)為(wei)準。
